We are Up and Running
I am pleased to report that the Judiciary Committee held its first organizational meeting today and we are up and running. It was the first Committee activity in which I was the Chair and I felt humbled and honored by the experience.

I'm Looking Forward to That First Meeting Too
and I'm glad to see the Committee addressing such an important issue at their first meeting. Will the meeting be televised on C-span?
It is very encouraging also to see that the Committee membership includes such articulate and activist members as: Representatives William Delahunt, Shelia Jackson Lee, Debbie Wasserman Schultz and Maxine Waters.
I cannot wait until we get the real investigations and hearings
Once that will lead to articles of impeachment against President Bush and his criminal cabal running the government. The hearings on the signing statements is just the first of many investigations that we can look forward to!
Neerav (a.k.a. "Angry Democrat")
That's great news, Chairman Conyers
thank you.
After watching Cheney nauseate the world on Wolf Blitzer today, it's an immense relief to know that you have our Judiciary Committee up and running. I am looking forward to the first oversight hearing as well, and to the restoration of Judiciary Committee integrity by one of the best Congressmen the United States House of Representatives has ever had.
Rusty, what is that pin that Cheney wears on his lapel?
Congressman Conyers, do you know?
I was keeping an eye out for it on the Wolf Blitzer interview. I've noticed this pin before. It looks similar to a US flag, but it has a very evident spot or mark of some kind where the stripes are. I cannot make what the spot is on my "low definition" TV, to see it clearly.
Has anyone who owns a high definition, big screen TV been able to make it out?
I'm going to write to Wolf Blitzer/CNN and ask if they know what Cheney wears on his lapel. It is NOT the typical US flag pin.
I've watched the Crooks and Liars video
but it's not very good quality. It looks like the upper left corner of the pin is blue, the lower right corner is red, and the other two corners are white. I'm sorry, TIA, I don't have a clue what Cheney's pin means.
I Suppose IF...
IF you have to start somewhere, well, you might as well examine what compels the man to create those caveats that grant himself such unconstitutional powers in the first place. "I'll follow the law unless..."
But to ask, under Bush? How about, at all!
Does the President have or hold the capability to craft law? Or merely to veto the crafted laws as presented so as to be sent back for better craftsmanship? If only to include Presidential caveats.
To be honest, I let out a big "All right!"

Looks like you also
get emotional when you get excited, Max 1. Here's a Hi-Five for you!!!
Really looking forward to the hearing
And may it be the first step in restoring sanity, honesty, dignity and integrity to our country and Constitution.
And is the first step towards impeaching Bush's sorry butt......
There is no other way to hold Bush and his war criminals in the Executive Branch of our government accountable BUT impeaching them all and then sending all off to the Hauge to be tried for war crimes in order to remove them from power, and restore Democracy in this country! IMPEACH NOW!!!
Neerav (a.k.a. "Angry Democrat")
Excellent news, Congressman Conyers!
Congratulations, Congressman Conyers, on getting the Judicial Committee up and running and fully staffed!!!!!!!
I LOVE the topic of your first oversight hearing! I also echo that I hope the hearing will be shown on C-SPAN. I think MANY PEOPLE will want to catch this hearing, sir.
Keep up the good work. I'm looking forward to your other hearings. In my opinion, you're starting off with a bang!!!
In fact, I'm so excited about this hearing topic, I'm sending a big HUG your way! (I get emotional when I get excited!)
Max1 -- TIA
Emotions are healthy -- if we didn't have emotions we would essentially be "dead" -- thanks to all of us who "feel" and "think" and are not numb, as so many these days seem to be. Our passions for the return of our country to its ancestry and founders are emotions of which we can all be proud because we see the philosophical soundness of the greatness therein.
The suppression of emotions,
Tahoe, can cause all kinds of physical and psychological problems.
In my opinion based on observation, I see a real emotional disconnect in many of the Republicans (can they really believe all those untruths???). I also take special note that certain Republican leadership and Republican radio and TV talking heads utilize this trait of emotional disconnect to manipulate their followers who obviously are out of touch with their own truthiness censors.
I often wonder if there is a genetic makeup that predisposes people to be "conservative." Sean Hannity took umbridge on his radio show this week about a study of the traits of children which evolved 20 years later into discovering what political parties they had chosen. It turned out that young children that had certain perceivable traits (some of them rather negative) turned into conservatives when adults!
I found the Psychology Today article that Sean Hannity was quoting online, but it appears to have a strict distribution copyright. If you'd like to read it (and I highly recommend that you do), do a Google search on these three words - study conservatives childhood - and it will come up for you.
Knowledge is power. It's very important to understand just what we are dealing with when it comes to the conservative mindset aka Republicans. Certainly Karl Rove and his ilk, certain media propagandists, as well as a breed of fundamental ministry understand and utilize manipulative techniques to the hilt to control the conservatives.
And how do you control conservatives? Through the use of fear. Just do as Bush does - how many times can you say 9/11, Mr. President???!!!
I'm proud to be a free thinking liberal, in touch with my emotions, able to perceive behind the curtain to the "wizard" manipulating in the control booth.
The World Needs a Toto Right About NOW!
To expose all those untruths...

Keep that in mind as we remind them...

You aren't defending, protecting, preserving the Constitution of the USA
When you allow the usurpations of the Constitutional laws of the USA.
That's profoundly interesting, Max 1.
I'd be REALLY curious to know how many times Bush has said 9/11 in all of his public speeches, as well as the rest of those words you posted. A time-consuming project, but perhaps it is out there on the net.
I agree, TIA -- there is much truth to those insights,
though I have not yet had a chance to "google" the words. There is some prevalence today with "disconnect" such as "yuppies" with their one tract minds. Somehow, I believe in the minds of such people that "disconnect" spells out "better than thou" sentiments. Above it all, so to speak. But "disconnect" also spells out a refusal to observe or "see" reality and to only "see" what you want to see -- ring a bell?
Thank goodness, there are those of us who are in touch -- in touch with our emotions and our ability to be conceptually honest, etc. I'm with you!
JC -- wonderful, this is the first GOOD news we've had in a
while -- YES, those signing statements NEED desperately to be dealt with. You're looking forward to it and so are we -- whatever steps may be taken in the RIGHT direction, we will be with you 100% (but I kinda' think you know that).
P.S. Glad to see that the Committee is up and running and your position of humility and honor is well understood by all of us (I say that in the spirit of what I believe to be "our" community here).
P.S.S. And I'm sure you know, as well, there is no TIME to waste.
Congratulations, Congressman
I share everyone's sentiments and excitement! I hope it's broadcast, as well, would be great to listen to this one.
Agreed - however -
It's not always possible to be "Johnny on the spot" when a broadcast is going on, and C-Span has its own agenda anyway. Is it possible to post the proceedings somewhere so that we can view them at our leisure - either as a PDF file or maybe in a Windows Media format?
The Mainstream Media (MSM) are all whores for Bush..............
Before we even do that, Feline, we need to reinstate the Fairness Doctorine in the media so we can REQUIRE that ALL media outlets report ALL sides of the story in afair and balanced manner, instead of doing the dirty propoganda work for the Bush Criminal Cabal!
Neerav (a.k.a. "Angry Democrat")
Live Blogging Congressional Hearings?
Yes, no doubt that bias still exists in the MSM, and that the Fairness Doctrine needs to be reinstated (hopefully soon).
Maybe someday live blogging will be allowed at congressional hearings, like the Libby trial...just an idea!
Untruths and Inconsequential Actions
Jan. 28, 2003 THE FELONY
Feb. 3, 2003 A BIGGER LIE THAT OMITS THE FELONY
Result?
Over 650 thousand Iraqis and 3000+ American soldiers silenced, FOREVER!
Revealed -
Sen. Chuck Hagel in an interview with GQ Magazine...and I edit for brevity...
U N A C C E P T A B L E!
That the President can knowingly commit a FELONY and be rewarded with a war that profits his friends.
WHERE IS THE JUSTICE?
Until there is some, anything goes with this group of corrupt mobsters. ANYTHING!
I hate to make the comparison, but Hitler didn't just want Austria when he invaded but the whole of Europe.
OPEN YOUR EYES MY FRIEND!
While it may not be the same, it is OF the same intention; HEGEMONY through military coercion (aka TERRORISM). It may not be as systematic as the Nazi's in Germany were, the clowns dressed in Presidential costumes, now, keep tripping over their egos. For that, we should be grateful. But to stand still and not flinch? PATRIOTIC SUICIDE!
Signing statements are what happens when LIARS are allowed to LIE.
Mobsters are what happens when criminals are allowed to profit from their crimes.
Band-aids? or surgical cancerous removal?
Is this really THAT tough of a decision?
Oh, I forgot...
IT'S ABOUT '08. ISN'T IT?
BULLSHIT!
What does '08 have to do with the National Security of a Nation shamed and loathed for their Foreign (non-diplomatic) Policy that ferments disgust each and every day the criminals are free?
As IF '08 will change this in the worlds eye? BULLSHIT!
National Security begins at home!
Bush's continual assault upon our securities and the continued infringement upon other nationals world wide happens because he's allowed to. In his most recent SOTU he addressed all of Congress and implored that YOU, Congress, continue the fight to keep America and Her people secure.
Let me remind you, Congressman, that it is the Constitution and the Bill of Rights that affords me my securities not the actions of men. Allow those securities to be taken away, and you do us a disfavor and a great injustice.
Give me Liberty or give me death

Judiciary hearings
Congressman Conyers:
It is nice to know that your Judiciary Committee is now organized and up and running. It is also encouraging to believe that hearings will be held to investigate the illegal actions of BushCo - past and present.
However, Congressman, many in the electorate are wondering whether these hearings will be mere data mining exercises or whether there will be appropriate consequences that will follow what is already known as well as what else might be discovered.
I read an interesting article by Tom Engelhardt and Elizabeth de la Vega earlier today, which included the following:
To read Tom and Elizabeth,s complete article click here
By the way, I have serious doubts that non-binding resolutions can stand up to Bush hubris and absent appropriate consequences it is unlikely that his signing statements will cease.
Your thoughts - please?
Thanks John keep us
Thanks John
keep us informed.
Roger The Okcitykid
Prepare for refusals.
Thank you Mr. Conyers for beginning the investigative process.
Since we already know that BushCo will simply tell you to "Go Cheney yourself", if you dare to expect any answers, can we expect arrests for contempt?
John Bolton was court ordered to provide information regarding his fact finding to impugn Joe Wilson, he refused, and was given a "recess appointment" to the UN with no repercussions. If he had been arrested for contempt, the FISA violations could have been presented in a manner that had nothing to do with terrorism.
Don't get bogged down while edifying America's reputation as a debating society. Go with violations George has admitted to. Don't give them an opportunity to stonewall the process.
Little things like George issuing more signing statements than all other presidents combined are indicative of his wish to usurp legislative powers from Congress.
When George mentions Article II of the Constitution, throw Article I at him. My pocket Constitution doesn't even mention the presidency until page 9.
Article. I., Section. 1. All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.
Thank you very much for making the investigation of Bush's claim to dictatorial powers, a first priority. But don't get bogged down with semantics. Go for his throat like Kent Starr went after Clinton.
Dick and George are beginning to drop all pretense of caring about our history as a Democratic nation. The faster you push these investigations, the more frantic and dictatorial they will sound, and the more evident it will be to many GOP'ers that they have been supporting a false prophet.
America has seen too many investigations and prosecutions that have taken years to complete, only to end with nothing. A case in point would be the Foley page affair investigation. Everyone shared a little blame and noone is accountable. Or the Teflon Tom DeLay trial that never was. Or Libby.
Thank you Mr. Conyers, but please hurry. We don't have time for stonewalling. Dick and George have dropped all pretense of love for America. At least a Democratic America anyways.
The spiraling effect of George,s delinquency
The first paper I wrote as a student of psychology years ago ,was about the spiraling effect of juvenile delinquency.
Although I thought I would never think about that paper again, there seems to be a connection to those pesky signing statements.
The main thought ,simple as it may be, is this: A child steals a piece of gum (A) , he gets caught, and is punished,is told what he did was wrong ,understands ,and never does it again. (B), Does not get caught, enjoies the gum , learns that he can get away with it. and then goes on to the next level. In effect he goes up a notch in an ever rising spiral, that leads to bigger and better things.
As it pertains to this subject. Bush has gone on many more levels, and now believes that he has the absolute right to do as he wants, Because until now he has not been told NO.
Now if you Rep. Conyers ,and the whole group of people that have come together to restore justice, does what I expect of you, George ,will be told NO.
He will be punished ,and because of the severity of his crimes, will be put away ,never to have the opportunity to commit crimes again.
I am holding my breath, and will be watching closely for any progress!
Yes, Mark, time is of the essence. There is no time for
to let any of it hang on a thread -- we are losing so much day by day, unless the "gruesome twosome" are stopped dead in their tracks. I hope that these ensuing two years coming are not what I fear the most -- Congress attempting to instill this or that law and Little Georgie vetoing or being signatory to signing statements out the arse, etc., etc. while he and Cheney continue on their merry way with their agenda, as always.
I saw this picture today and can't resist throwing it in. The Hunted This is our leadership?
The future we voted for? Or the one we were warned about?

We are fast approaching the stage of the ultimate inversion: the stage where the government is free to do anything it pleases, while the citizens may act only by permission; which is the stage of the darkest periods of human history, the stage of rule by brute force.
- Ayn Rand, The Nature of Government
I have no desire to get embroiled in the current tangled debate on immigration, either legal or illegal. However, I have watched with interest the intense campaign for President Bush first to intervene in the trial of two Border Patrol agents accused of shooting a suspected Mexican drug dealer as he fled, and then to pardon the agents for the crime after they were convicted.
CNN's Lou Dobbs has led the crusade against illegal immigration for the past several years, and he seems to be in the camp that believes if you're an immigrant and you're illegal, the gloves come off. You deserve what you get. I agree with Dobbs that our borders must be secured and that Mexicans entering our country legally should be welcomed, as they have been throughout our history. However, those like Osvaldo Aldrete Davila who slip across the border illegally should be stopped and sent back home - not shot as they are trying to escape.
The agents, Ignacio Ramos and Jose Alonso Compean, entered prison last week amid shrieks of injustice, to begin serving sentences of 11 and 12 years. They were convicted not only of shooting Davila, who was unarmed and running away, but of destroying evidence, covering up a crime scene and filing false reports concerning the circumstances.
Right-wing pundits and politicians on both sides of the aisle, seeking political gain, are clamoring for Bush to pardon Ramos and Compean for their "act of courage" and to ignore the laws they broke and the crimes they committed.. Although Congress has never bestowed a pardon on anyone convicted of a crime, in a ploy to get attention last week, presidential hopeful Duncan Hunter (R-Calif.) introduced a bill demanding that Congress, rather than Bush, pardon them.
That's not likely to happen, so the pressure remains on Bush. In an interview in El Paso last Thursday, Bush was asked if he would consider pardoning the two agents. In classic Bush bumblespeech, he non-replied, "There are standards that need to be met in law enforcement, and according to a jury of their peers, these officers violated some standards."
Bush then stammered, "On this case, people need to take a hard look at the facts, at the evidence that the jury looked at, as well as a judge. And that's - I will do the same thing. Now, there's a process for pardons," he continued. "I mean, it's got to work its way through a system here in government. But I just want people to take a sober look at the reality. It's a case, as you said ... it's got a lot of emotions."
Upon hearing this, news sites such as NewsMax.com, jumped out with, "Bush Eyes Pardon for Border Patrolmen," and announced, "President Bush on Thursday said a pardon was possible for two Border Patrol agents serving prison sentences for shooting a Mexican drug dealer as he fled and then covering up the crime...."
For NewsMax to reach such a conclusion from Bush's twisted rhetoric is not only a stretch of the imagination; it's a classic example of wishful thinking. The "standards" that the two agents "violated" were laws they broke, for which they were convicted by a jury of their peers. Ramos and Compean are criminals. According to the Justice Department, the "process for pardons" that Bush says has to "work its way through a system here in government" is that once convicted, a criminal is not even eligible for consideration to be pardoned for at least five years.
The bad news is that even if Bush, who is determined to work not above the law but outside the law, decides to "eye" pardons for the two agents, he will rely on the recommendation of Attorney General Alberto Gonzales. Given the Bush-Gonzales history of compassion for their fellow human beings, it's a slam-dunk that Ramos and Compean will remain incarcerated. The good news is they were not sentenced to death....
The only coherent statement Bush made is that the Border Patrol case has "got a lot of emotions." I don't pretend to understand all I know about illegal immigration, but it seems likely those emotions will get uglier and more intense if this administration continues to nod and wink at securing the border between the United States and Mexico. If there is a policy other than to give no-bid contracts to Halliburton to build a network of detention camps where immigrants will be held indefinitely, I'm not aware of it. I find it difficult to believe that these camps are cheaper - more humane - than simply closing the border to illegal entry.
Those who cry that the border between Mexico and the United States stretches for 2,000 miles and is all but impossible to control apparently are unaware of the new passport requirements that went into effect on January 23. Air travelers going to or from the US, Canada, Mexico, the Caribbean and Bermuda must have passports.
Those who have no problem with [requiring passports] for air travelers should know that as early as January 2008, they're coming back for the rest of us. According to just the basics, "All persons - including U.S. citizens - traveling between the US and Canada, Mexico, Central and South America, the Caribbean, and Bermuda by land or sea (including ferries), may be required to present a valid passport or other documents as determined by the Department of Homeland Security."
Americans who cherish freedom would do well to stop stumbling around in the trees and forests of the illegal-immigration debate and see that the Bush administration is well on its way to closing the borders of the entire nation, not only to people trying to get in, but to citizens trying to get out. For the millions who don't travel, it's probably no big deal - they long for the tranquility of servitude and do not recognize shouts coming from the rest of us as a desperate rattling of chains.
Unfortunately, securing the homeland is a two-edged sword that the Bush administration and military establishment profiteers are holding firmly over our heads. It's time Americans realized that we are in danger of being herded into a national detention camp in which there are no pardons, and from which there is no escape.

Conyers and Feingold Announce Judiciary Hearings
Thank you Congressman Conyers. I hope you and Sen. Feingold have the support you need to get this started.
Conyers and Feingold Announce Judiciary Hearings on Bush Admistration Policy in Both Senate and House...
Conyers and Feingold Announce Judiciary Hearings
Senate & House Judiciary Hearings on Bush
FYI: Conyers and Feingold Announce Judiciary Hearings On Bush Administration Policy in Both Senate and House Here,s are (snips) from the Bradblog report (via Rawstory.com):
"…Two announcements were released today concerning upcoming oversight and investigative hearings in Congress on Bush Administration policy…
"…In the House, Rep. John Conyers (D-MI), chairman of the House Judiciary Committee --- the one which would lead the way concerning any Articles of Impeachment for a sitting U.S. President or Vice-President --- announced today that hearings would be held next Wednesday in the committee on "Presidential Signing Statements under the Bush Administration: A Threat to Checks and Balances and the Rule of Law?" (Complete media release, with details, scheduled witnesses, etc. at end of this article.)…
"…In the Senate, Russ Feingold (D-WI) will chair Judiciary Committee hearings on "Congress' Power to End a War." In a media advisory just released, (posted in full below) Feingold refers to Congress' "power of the purse to redeploy our troops safely from Iraq so that we can refocus on the global terrorist networks that threaten our national security…" (End of quotes)
Even though the Democrats won the majority, Congress--especially the Senate--is still so divided that even a "nonbinding" resolution to remind an out of control president that the Congress is still a part of government with a voice on funding of the military, is so controversial that the vote came down to a 12 yea, 9 nay total. In this still toxic atmosphere, Congressman Conyers and Senator Feingold have stood up and taken the first steps that could lead to change. What can we do to help? We can call, write, visit, fax--each member of Congress to remind them we've Had Enough, it's time for Accountability, and that we support Rep. Conyers' & Senator Feingold's Hearings.
Senator McCain is playing defense for Bush, by stubbornly and obstinately trying to block Chairman Levin's call for benchmarks. Lieberman has the colossal gall to say anyone who questions the President is guilty of treason. It's time to let the likes of McCain, Lieberman, et al know exactly who it is that is guilty--of treason, guilty of sending people to die needlessly, enabling multiple continuous violations of the Constitution, of allowing the US to torture people, etc, etc.
I just pissed myself laughing...
...at this.
The irony is palpable.

GK - sorry for your circumstances!
Was that Rove's last stand? LOL
Does it make any difference?
The man has a hammer, and Iran looks like a nail. Cheney, that unregenerate SOB, has every intention of starting World War III as soon as he can. Then everything else goes by the board, because "You don't change horses in the middle of the stream," even though the horse may be dead.
The investigation of the totally unconstitutional, illegal, immoral (and fattening?) "Signing Statements" is important, yes - but we have FAR MORE IMPORTANT items on our plate. For the very survival of our Nation, we MUST REMOVE GHENEY - NOW!!! Articles of impeachment against that unamerican egotist can be drawn up in a day. Peculation, bribery, outing of undercover CIA agent, influence peddling - hell, his corruption has been so open and blatant that he is hanging by a thread now - when a rope around his neck would be more fitting. Start the removal process before he starts a war we cannot win, and drives us completely into third world status!
That sounds like a plan, Kory.
Bush can't walk far without Cheney, although I'd be more comforted if you added Alberto Gonzalez to that list as well.

George is a snivelling, ex-party boy without him. The Washington Post reports this morning that Bush has authorized that Iranian operatives can be killed in Iraq. The Eisenhower and the Stennis aircraft carrier battle groups are converging on the Arabian Gulf. What else will be done to provoke a military confrontation with Iran in these last two years?
For God's sake,
IMPEACH CHENEY
AGAIN, IMPEACH CHENEY
From MSNBC,
WASHINGTON -- Special Prosecutor Patrick Fitzgerald used his opening statement in the CIA leak trial Tuesday to allege that Vice President Dick Cheney's chief of staff lied about Cheney's early involvement in the disclosure of a spy's identity.
Fitzgerald said Cheney told his chief of staff, "Scooter" Libby, in 2003 that the wife of Iraq critic and former ambassador Joseph Wilson worked for the CIA, and that Libby spread that information to reporters. When that information got out, it triggered a federal investigation.
"But when the FBI and grand jury asked about what the defendant did," Fitzgerald said, "he made up a story."
Fitzgerald also alleged that Libby in September 2003 "wiped out" a Cheney note just before Libby's first FBI interview when he said he learned about Wilson and his wife, CIA operative Valerie Plame, from reporters, not the vice president.
It was not clear if Fitzgerald meant that an attempt was made to destroy the note or that Libby had forgotten about it. In any case, the note was recovered and is part of the evidence."
According to the CIA World FactBook, a full half of Iran's population is under 25 years of age. Change in Iran is only a matter of time. Attack Iran, and that change will no doubt not be for the better.
I'm sorry, Korryander, But I disagree.
The mutability of the law may be the central point of (he waves, all inclusively) the Oh-Oh Decade.
The consideration of this led me to thrash around abit, and I came upon Gonzos' response to a series of questions posed by Mr. Sensenbrenner about a year ago, the essece of which, was where do you find this astonising, heretofore unheard of authority? (Thank you, Mr.Chairman)
It's a pretty sexy question, No? It follows the answer should be too. But, no. The only thing I have to compare it to was a high speed transit of the Pacific. A sonarman has a job, that is to listen. Intently. If there be nothing but flow noise (white noise) then that, he listens to, intently. Knowing that he will hear nothing, that does not originate in his own head. Knowing also the only thing he might possibly hear would be own ships noise bouncing off a mountian, dead ahead. And knowing if he did hear that, he wouldn't have time to make a report. After a few hours it becomes disorientingly boring. As in, fall over. There is something about the way Gonzo answered that question that put me into that condition in minutes, where white noise took hours.
Is Gonzo really that good?
I say this by way of warning. I hope others will not have this experience, but wonder if they might. The upshot I gleaned from the experience is...Gonzo and company are very good at inferring things. He/they see things in the Constitution that, in reality, exist in thier own eyes, exclusively. Are not. Were never. Would never be. Put into the Constitution. Because the presence of those things in that document would more than tend to make the writing of it a pointless exercise.
Artical II Section I
The executive power shall be vested in a President of the United States. There follows several technical points reagrding who may be Pres, how he is elected, for how long, what he gets paid, then some more good stuff - The Required Oath:
I do solemly swear that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.
This, aside from a trifling matter in article I section VII Which the Chairman intends to investigate FRIST, is all the Constitution has to say of the "Commander in Chief". This might seem sparse, even scant, untill upon reading the rest you come upon the clarifying clause that delegates to Congress the role, perogative, the power, the RIGHT, :
This makes quite useless any enumeration of specifics in regard to the powers delegated by the Constitution to the President, and that the Constitution does not do. It instead delegates to the Congress the RIGHT to delegate to the President his Constitutional powers, when and as the Congress sees fit, for such purposes and periods as the Congress deems expeidient.
The President, by Contrast, is delegated the Constitutional power to take care the laws be faithfully executed. (Italics, above)
Yet, somehow, Gonzo and company mange to read into these few, and very restrictive words, a grant of unlimited power, exceeding even that of the King We rebelled against in order to create the Office of the President of the United States, so that We, and each of us individually, could be free of, What? Why, of course, the Tyrranny of that very same King.
I'm sorry to disagree with you, Korryander, But I have come round to thinking the Chairman Has elected to start at the beginning.
Signing statements let the President write the rules. A decider needs to be able to do that. That is why the Constitution puts that power into many other hands. Untill that power is secure, The President will misinterpret anything he doesn't care for into whatever he likes...
Taken as a whole, Artical II seems not to exalt the Presidency. It seems instead to imply a deferance by the President to Law, and through it to Congress, and through them to the People...As might be expected. Artical II seems not, however to suppose there might be any problem regarding what the definition of Is is. Artical II expectes the President will understand English. Step one has to be fixing the facts around the policy. George has a real bad habit there.

Sorry about length.
White Noise Clearing Up NOW!
I make no claim at being good at this but have had a revelation of sorts, thanks to Frosted here and reading Glenn Greenwald's latest post Public servant v. Military Commander.
Let me rewind to an instance during the President's SOTU speech that struck me as odd. He mentioned about building troop depths:
What is a Citizen Reserve Corps? And how does he, as our President, then become our Commander in Chief over a Citizen Reserve Corps? But I'll put that question on the back burner for now...
My big A-HA(!) came when I was reading Greenwald today with the fuzz of Frosted hanging over me (lol) when I suddenly got it! We are at war (where is that Declaration?) and the one leading the Nation into and through this time is not(!) obeying the law, and so the people have a quandary to attend to. How does one Impeach a Commander in Chief during a war but by returning him to the position he started in - President of the United States of America and thus a public servant.
Why can't Congress appoint the duties and authorities of Commander in Chief to "other" respective and respected heads, thus rendering the President back to being our public servant and fully accountable to the public? No hiding behind presumed War Powers clauses or Unitary Executive Deciderness's.

Great points, Max
My hat is off to you.
Doesn't look to me like you disagree at all - - -
What you did was amplify. Very well done, too - I might add. BUT - the "Unitary Executive" that Bu$h tries to typify and Gonzo (I love it!) tries to defend, are Cheney creations! Tell me - what would you rather be - the King, or the person who tells the King what to do, and is slavishly obeyed, because the King has no ideas of his own? I think the question answers itself. I do NOT believe that Bu$h dreamed up all those signing statements himself; he is functionally illiterate, and mostly uninterested in the day to day practice of governance. I could easily be wrong, of course, but I do sincerely believe that left to his own devices, even afer six years, the Man has NO CONCEPT of what the Presidency is! He lets Dick do it - so my contention is simply that we have to get Dick out of there before he gets us into WWIII. It could easily be that investigating the Signing statements is a valid step on the way, because any comparison of the syntax of those statements and Bu#h's barbaric misuse of the language is going to show that he did NOT write them! Then who did? Cheney? Gonzo? Both, in cahoots with Condi or Donny, or Grover? I think it is going to become VERY evident that Bu$h has no concept of what his oath of office actually meant - but remember, he does NOT have the intelligence required to craft a compound sentence without a half dozen egregious errors. It is definitely time to pay attention to that man behind the curtain!
Well, in that case...
I'm sorry to have misunderstood you.
I withdraw everything I said.

Off topic - North American Union
For those interested, Lou Dobbs has taken up the challenge of reporting on the North American Union. Yesterday he interviewed Robert Pastor, known as the architect of this Congress-overriding idea. It was one of the interviews toward the end of the show.
Here is a portion of the transcript. The full transcript is available at http://transcripts.cnn.com/TRANSCRIPTS/0701/25/ldt.01.html, but you must scroll about 3/4ths of the way down to find the segment.

DOBBS: Two years ago the Council on Foreign Relations published a report titled "Building a North America Community." among the goals expressed, to break down trade regulations between the United States and Canada. Between Canada and Mexico and of course, then the United States. But without congressional approval or certainly without congressional oversight or voter approval.
Critics call the plan the North America Union. And many say that it would ultimately destroy U.S. sovereignty.
Robert Pastor is a member of the group that broke the original report. He joins us tonight. It's good to have you with us.
ROBERT PASTOR, CENTER FOR NORTH AMERICAN STUDIES: Thank you very much.
DOBBS: Robert Pastor, you were co-chairman of an independent task force sponsored by the Council on Foreign Relations, and in this report titled "Building a North American Community" the president of the Council on Foreign Relations, Richard Haass states, "The Task Force's central recommendation is establishment by 2010 of a North American economic and security of community, the boundaries of which would be defined by a common external tariff and an outer security perimeter."
At this point what is the basis for moving forward on that?
PASTOR: Well, the United States, Canada and Mexico now are already the largest free trade area in the world. We have $800 billion worth of trade. This is a source of comparative advantage for the United States. But the council report feels that we could take greater advantage if we were deepen economic integration, if we can secure ourselves better, not only at our borders, but also by thinking about continental security perimeter as well.
DOBBS: Why would you think about, just out of curiosity, a common security perimeter when the United States does not have secure ports nor does it have anything approaching secure borders?
PASTOR: Well, it's precisely because our ports are not secure and our borders are not secure that we need to find not only better ways to do that but also better ways to turn our two neighbors into partners to enhance our security and to enhance our prosperity as well.
DOBBS: And that can't be done with sovereign nations? There has to be integration of an economy? A customs union, if you will? And a common security perimeter?
PASTOR: I think the vision defined in that report is one of three sovereign nations cooperating with each other to deepen economic integration, to create a common external tariff, to improve our economies and to secure ourselves better.
DOBBS: Let me ask you, the Banff meeting in September of last year. You were there, weren't you?
PASTOR: I was.
DOBBS: And representatives of all three governments. Military, business, economic ministers and commerce officials. Why was the press not permitted to be there?
PASTOR: Well, there were press in the room. But the leaders of the three groups decided that they wanted to keep the discussions active and vigorous, and therefore confidential.
My personal view is that I would have preferred for the meeting to have issued a statement or a report afterwards. And I hope that if the group comes together again that they'll do that.
DOBBS: Under what authority are they coming together?
PASTOR: Oh it was a conference.
DOBBS: I know it's a conference. I'm asking what authority?
PASTOR: I think the three leaders. One was George Schultz from the United States. Peter Lougheed, the former premier of Alberta, Pedro Aspe, a former minister of finance of Mexico. Just assembled a group of about 75 people.
DOBBS: Just willy-nilly, got together.
PASTOR: Oh yes, don't you attend conferences from time it time to learn about the world.
DOBBS: No I prefer frankly to learn about the world through travel, my reporting, my reading and studying. The fact of the matter is, I really have an aversion to conferences altogether. But I know that some people make a living on them. Who is paying for all of this?
PASTOR: Well I was not organizing that. You'll have to get to the organizers of the conference. I think foundations. There may have been some corporate sponsorship as well. I was just invited to it.
DOBBS: Right, you also are considered by many to be the architect of this North America Union, or competitors council as it's coming forward.
I would like to ask you something, I found rather curious in the North America Forum. Saying, "While a vision is appealing, working" - this, by the way, brought forward by Judicial Watch through freedom of information.
"While a vision is appealing, working on the infrastructure might yield more benefit and bring more people on board, evolution by stealth."
Why should anyone in this country, Mexico or Canada, presuming they're interested in the sovereign rights and power of their respective nation, tolerate this kind of elitist nonsense?
[If your interest is piqued, and I hope it is, the rest of the transcript can be read at the link above.]

Oh, mh GOD!!!
George Shultz is one of the "Architects" of this cockamamie plan? That - person - has singlehandedly done more damage to the structure of the United States than anyone I can think of, except possibly Dicky Scaife! He is one of a small gang of traitors who live with the sole goal of destroying our National Sovereignty. He is a fascist thug who should be tarred and feathered and put on display as the archetype of treason. He and Felix Rohatyn are among the gang that wants us at permanent war, with no particular choice of enemy. Offhand, I can think of no better reason to be against this boondoggle except the fact that he's for it!
Repeat frequently. I live in the United States.
One method the big thinkers of the new world order are using to confuse the people of the United States, is to continuosly refer to the United States as America. But America is actually comprised of 2 or 3 continents, North, South and Central. Is Central America a continent or a geographic reference point? The country I live in is called the United States.
After they get America's children accustomed to being called Americans, and not citizens of the United States, the door will be open to claiming our manifest destiny. While the United States enjoyed a reputation as a representational Democracy, America has no such obligation.
I've argued with many neocons who seem to be very adamant that the United States should be referred to as America. All of their arguments have a definite Rovian or Orwellian twist. Renaming the United States, America, paves the way for the Empire builders.
Yes, I am an American. But so are Nicaraguans, Venezualans, Mexicans and Canadians. I live in the United States. My nation just happens to be in the Continent called North America.
If these anti-United States forces succeed in creating a North American Union, who's laws will the fortunate elitists be forced to obey? Everyone's? Or noone's?
The bogus listening device story, in the Canadian coin, was designed to frighten the easily frightened into believing that the slackers up north aren't taking our "safety" seriously enough. This was a stepping stone to the future usurpation of Canada. The fact that the story was completely bogus didn't get imprinted on the brains of the rank and file. But many people in my county are pissed that these borderline communists would endanger us all with their naivete.
Hell, my area last attacked Canada in the late 1800's. But the rest of America has probably never heard of the rebellion of the Black Irish in the Malone, New York area. We had about 4,000 pissed off Irishmen in Canada, before we realized that reinforcments weren't coming. The conquest of Canada would have to wait.
I feel it is very important to combat the PSYOPS experts that insist on calling the United States, America.
I like our history, I like our Constitution, and I liked the position we enjoyed as a benevolent presence prior to the ascension of BushCo.
I may be American, but I live in the United States. I want to keep it that way. Let your children know that the United States is something to show pride in.
Call it the United States. Don't let the psychologists of Bush's propaganda brigade change our name to America.
But George is the great divider, not uniter. He doesn't want a United anything.
God Help America--The "Decider" Is Back
Bush: "I'm the Decision Maker on Iraq"
Snip: "President Bush, on a collision course with Congress over Iraq, said Friday "I'm the decision-maker" about sending more troops to the war. He challenged skeptical lawmakers not to prematurely condemn his buildup..." Of course, what he actually means is: "Come up with MY plan & I'll go along; otherwise, butt out".
Meanwhile, Rep. John Murtha (remember him-he,s the combat veteran who had a plan for Iraq that if it had been implemented would have saved hundreds of American troops, lives,) and Speaker Pelosi are in Iraq, doing their own assessment of the situation there. They have to go there, because the real reports about what,s happening aren,t getting through: Helping Lara Logan Get "Battle for Haifa Street" Aired If this link doesn,t work, here,s the link via this Kos Diary
Funny, I thought it was Congress that had the power to authorize war, and to fund the military, not the self-appointed "decider".Apparently Bush has come to believe in the last six years that he is in essence, a dictator, and that Congress is merely a rubber-stamping window dressing, a "quaint" symbol of Democracy, whose time has passed.
BTW, how are things going in Iraq, under the Decider?:
Loss of Single Helicopter is a (Command & Control) Disaster. On this helicopter were a lot of high ranking, experienced people:
2 Colonels
1 Lieutenant Colonel - One Col. Was the top ranking Medical Officer for US troops in Iraq.
1 Major
1 Captain
2 Command Sergeant Majors
1 First Sergeant
1 Sergeant First Class
2 Staff Sergeants
1 Corporal

Congress, how many more deaths are you willing to allow before you understand that the Commander-in-Chief is unfit for command?
It,s time to take over the wheel from the decider,s runamok administration. As Josh Marshall,s TPM reader AC comments re: Decider:
"...But now there's a congress with a mandate to oppose him. If I were Harry Reid or Nancy Pelosi, I'd take that as a sign that I have to show SOME sign ˆ any sign ˆ that I have the power to say no. Bush is showing he really doesn't think Dems will take any action ˆ in fact, he's basically daring them to rein him in, even though that's exactly what Americans charged them with doing last November. And you know what the saddest part is? He's probably right... The longer Congress delays, the more people who will die.
Congressman Conyers, I hope that AC is wrong and that Congress will reassert it,s Constitutional authority, by whatever means necessary to stop the bloodbath that is now Iraq. The people gave the mandate in November, 2007. The longer Congress delays, the more people who will die needlessly to try to salvage the "Decider's 'Legacy'".

Thanks Unspun
Decider Bush doesn't like listening to:
Maliki
The Iraqi Government
The Iraqis
The soldiers fighting his war
The generals that were on the ground
The Democrats
Congress
The American voters
Iraq Study Group
I'm sure there are more that can go on this list however listing them still doesn't help the decider to listen to anyone. The man acts as if he now owns the rights to Democracy and has bestowed upon the country of Iraq, their freedom from a tyrant that kept sectarian divisions in control and violence tamped down. And what does he say to all of this but that the Iraqis aren't grateful enough!
Dictators act this way. They ignore conventions of law to get their way. They choose who to listen to and even then only to those that speak what the dictator wishes to hear. They threaten those that get in their way and they like to manipulate the on-lookers into believing that the dictator cares about the future. Dictators are extremely self serving creatures. It's their way or no way at all! NO?

Wrong link Posted To Lara Logan,s Report
I inadvertently posted the wrong link in my previous comment. Sorry. The link I posted was listed in the Kos Diary that I also referred to in the post. The link posted in error was to a disturbing BBC report that shows US troops watching as (Shia) Iraqi troops beat (Sunni) civilians. It is a disturbing report and though I didn,t intend to link it, the video illustrates why our troops don,t belong in the middle of a civil war. The link to Lara Logan,s video is here

Bush Clears All Measures Against Iranians in Iraq
By THE ASSOCIATED PRESS
Filed at 11:25 a.m. ET
WASHINGTON (AP) -- President Bush has authorized U.S. forces in Iraq to take whatever actions are necessary to counter Iranian agents deemed a threat to American troops or the public at large, the White House said Friday.
''It makes sense that if somebody's trying to harm our troops, or stop us from achieving our goal, or killing innocent citizens in Iraq, that we will stop them,'' Bush said. ''It's an obligation we all have ... to protect our folks and achieve our goal.''
The aggressive new policy came in response to intelligence that Iran is supporting terrorists inside Iraq and is providing bombs -- known as improvised explosive devices -- and other equipment to anti-U.S. insurgents.
''The president and his national security team over the last several months have continued to receive information that Iranians were supplying IED equipment and or training that was being used to harm American soldiers,'' National Security Council spokesman Gordon Johndroe said.
''As a result American forces, when they receive actionable information, may take the steps necessary to protect themselves as well as the population,'' Johndroe said.
Bush referred to the new policy in his Jan. 10 address to the nation in which he announced a buildup of 21,500 troops in Iraq. He said the United States would confront Iran and Syria more vigorously.
While promising tougher action, the White House said the United States does not intend to cross the Iraq-Iran border to attack Iranians. . . . . "
Bush Clearance
Saber Rattling or Iraq Deja Vu?
I've been reading comments from experts, like Richard Clarke (who I respect) who have stated that they think the "tough talk" regarding Iran is a calculated diplomatic move to send a message to the Iranians to "rein in" their President. Could this work? Maybe, if given enough time and with due care not to escalate provocations to the point of uniting the Iranians against the foreigners.
What is disturbing, however, is that even given the history of the Bush Administration's promoting error-filled misinformation to lead this country to war in Iraq, people who should know better are supporting the neocon talking points. Even these Democrats have made the following hawkish statements: First there was this:
Democrats: Nuclear Iran Unacceptable
"...Iran with nuclear weapons is unacceptable, new House Majority Leader Steny Hoyer told The Jerusalem Post hours after entering the party leadership position...He also said that the use of force against Teheran remained an option. .."
and then this: Edwards: 'Iran Must Know World Won't Back Down' Raw Story Reports on 1/23/07 "...In a speech at a conference in Herzliya, Israel, former Senator John Edwards (D-NC) took aim at Iran, warning that the "world won't back down...all options must remain on the table," in regards to dealing with Iran, whose nuclear ambition 'threatens the security of Israel and the entire world...Let me be clear: Under no circumstances can Iran be allowed to have nuclear weapons,, Edwards said..."
While a certain amount of saber rattling and "show of force" may be necessary to send a message to Iran, I fear that this unqualified support by Democrats may well lead Bush to believe that there wouldn't be much opposition to his initiating a first strike on Iran. Unfortunately, as many of us do understand, the consequences of this action could be nightmarish. Senator Kerry's statement yesterday via this Kos diary showed that at least he "gets it":
"I am hardly the only one in the Senate who is concerned about a terrible byproduct of the administration's escalation plan for Iraq. That byproduct could be movement towards a calculated military conflict with Iran, which would further destabilize the Middle East, fan the flames of intra-Muslim and Muslim-Western violence. In fact, many Americans are increasingly concerned that the administration's rhetoric regarding Iran sounds eerily familiar."
I fear that if we don't let our congress members know that we don't want to be led into yet another war, while out overstretched, undermanned military are continuing to be slaughtered in Iraq--some of them will continue to ally with the neocons & lead us into not only an escalation in Iraq, but a regional war, that could even spread beyond the region.
To try to gain some perspective: Pakistan has nukes, India has nukes, N. Korea has nukes, China has nukes, Russia has nukes--though this isn't a good situation, and none of these countries are exactly our very best friends, the sky hasn't fallen in. Iran hasn't shot a satellite out of earth orbit yet. China just did so--showing it is perfectly capable of downing US communication, military & spy satellites, should it choose. Yet, our leaders blow out of all proportion the treat posed by Iran, while basically ignoring the disturbing news out of China. IMHO, the Administration & the circling hawks need to pull in their horns, and quit stirring up conflicts that we have no ideas how to resolve satisfactorily. What the country needs is some clear-headed, balanced, wise, expert brainstorming with objective threat assessments. Instead, BushCo & the blood-thirsty hawks want to continue to deplete the military, and make this country vulnerable to retaliatory strikes. Apparently they never heard the homily: "Let Sleeping Dogs Lie", an especially wise move, when other "dogs" are nipping at our heels unnoticed.
